In 2025, South Carolina legislature enacted a new law called the Hands-Free and Distracted Driving Act,
which takes effect on September 1, 2025. This is big news for Law Firms and Insurance Companies! Most
states restrict texting on your cellphone while driving, but this new law adds more restrictions, including:
- Holding or supporting a mobile device with any part of their body [while driving]. NOTE: This does not prohibit the use of an earpiece or device worn on the wrist used for voice-based communication.
- Using any mobile device to read, compose, or transmit texts, emails, app interactions, or website information, [while driving].
- Watching motion on a mobile device, including a video, movie, game, or video call, [while driving].1
